SB 398 -- POSTING OF PROPERTY

SPONSOR:  Barnitz (Loehner)

COMMITTEE ACTION:  Voted "do pass by consent" by the Committee on
Agriculture Policy by a vote of 11 to 0.

Currently, property owners may paint purple marks on fence posts
or trees around an area to prohibit trespassers.  This bill
allows the purple marks to be posts capped or marked on at least
its top two inches if certain specifications are met.  Prior to
marking a fence shared by different property owners, all owners
or lessees must agree to the marking.

FISCAL NOTE:  No impact on state funds in FY 2010, FY 2011, and
FY 2012.

PROPONENTS:  Supporters say that the bill provides an additional
option for the posting of private land.

Testifying for the bill was Senator Barnitz.

OPPONENTS:  There was no opposition voiced to the committee.
